Q What are the pros and cons for each - leasing and freehold?
A Freehold states your company as the legal owner of the land and the
house. And as you can see in the previous sentence - you are required to set up
a Thai company with at least 75% of the shareholders being Thai nationals on the
date of the land transfer. Thus
you will have to pay taxes and truly run the company, as there are severe
penalties on so-called "ghost companies" which exist merely on paper.
The easier way is to lease a Khao Lak Villa 2 home for a maximum period of 30 years with option
of extension for yet another 30 years, as that is the maximum lease period allowed by Thai law.
Your name will appear in the official house paper "Tabien Baan". The
pros here are obvious, as no company is required. The cons are that your
ownership is restricted to 60 years.
Q What land title deed exists for each villa and apartment?
A A Chanod title deed, which is the highest and safest one you can
get. It certies full ownership and the right to resell it without restrictions.
Q Is buying a house in Bangniang, Khao Lak a good investment?
A A definite YES, because property prices are expected to rise at a rate of 15 to 25% annually in Khao Lak !
Q Why do you advise against prime beach front land?
A For many reasons: For one, prime beachfront land is too expensive. 2ndly it is just paradise in the high season (Nov. - Apr.), but hell
during low season (May - Okt.). Because then the winds and seawater are basically beating your property into bits and pieces. The incoming mixture of
seawater, rain and sand will destroy wood, metal and aluminum in no time - anything electronic in your villa will be gone within 2 years since the
electric parts inside will just rust away. You will need to totally renovate your property every year, plus is the sea in the low season so loud that you
can hardly sleep. Plus is the ocean taking away a fair amount of beach each raining season. The 3rd point is: You don't own the beach! Since it
is public land, everyone is permitted to happily pass by in front of your property. Also, you won't be able to chase away any Thai beach chair vendors
or any other Thai person who decides to do business in front of your property, since it is public land. As you can see, the odds against prime beachfront land
are plenty! You will be better off with third row or behind and let your neighbors take the beating :o)
Q I need the villa only during winter time. Can I rent it out to
someone in the meantime and can you help me to manage this?
